According to the Boulder Daily Camera, the Boulder District Attorney’s office is appealing a decision made in the case of Stephanie Rochester, which could have significant impact on trials of similar cases in the future. During a trial in which Ms. Rochester’s defense was that she was not guilty by reason of insanity, she had to psychiatrists testify that she was insane at the time of her crime. One of those psychiatrists worked for the defense team, while one worked for the state mental health hospital. The prosecution asked the judge to allow them to hire a doctor to examine Ms. Rochester, but their request was denied. The District Attorney’s appeal of the decision would not affect the Rochester case, but if successful, it would set a precedent for similar cases in the future.

Advocates Push For Mandatory Reporting | Boulder Elder Abuse Attorney

The Denver Post reported recently about Charles Carter, an 82-year-old former lobbyist who is working to correct the fact that Colorado is one of a very few states in the U.S. without mandatory reporting laws for suspected elder abuse. School teachers and staff, doctors, and other professionals who work with children in Colorado are required to report suspected child abuse, but currently the same is not true of elder and other at-risk adult caregivers. Mr. Carter would like to change that, and one ally in his struggle is First Judicial District Attorney Scott Storey, who has said that he would like to see a law in place within the next year to two years. Mr. Carter has been lobbying for mandatory reporting for the past thirteen years. One mandatory reporting bill that he helped support actually making it through the legislature in 2005 but was vetoed by Gov. Bill Owens. Some people present arguments against mandatory reporting laws, but with such laws already in place in 46 states, there are plenty of places to look that suggest that the laws are effective and beneficial.

Elder Financial Abuse Law Now In Effect | Boulder Elder Abuse Attorney

According to The Gazette, the Colorado Senate Bill 10-042, which is an attempt to protect against elder financial abuse, has gone into effect. The new law now requires financial institutions, such as banks and credit unions, to offer elderly or impaired customers a chance to sign an information release consent form. This information release form will allow the financial institution to provide account records to law enforcement and social service authorities when financial abuse is suspected. It is thought that banks and other financial facilities are aware of their customers spending habits and circumstances. Because of this, it allows these facilities to be able to detect sudden or unsuspected financial changes. The form is voluntary and once it is signed it will remain active until canceled by the customer.

Hit and Run Leaves Pedestrian in Serious Condition | Boulder Pedestrian Accident Attorney

Vehicle-pedestrian collisions are very dangerous and are often seen as negligent driving of the vehicle. This could explain why many hit and run accidents involve pedestrians. According to the Boulder Daily Camera, a CU student was hit while crossing a street in Boulder on Wednesday evening. The crash occurred on Baseline Road near Canyon Creek Drive around 5:25p.m. The student, 23 year old Mary Wakeman-Linn an economics major, was crossing the street within a crosswalk when a car struck her and then sped off. The student was taken to a nearby hospital with serious head and internal injuries. Police officials are investigating materials left at the scene of the crash and continue to search for the vehicle involved in this hit and run collision.

Proposed Boulder Law to Reduce Bicycle Accidents | Boulder Bicycle Accident Attorney

This new speed limit will hopefully reduce the number of pedestrian and bicycle accidents that are unfortunately pretty common within Boulder city limits.

2nd Time this Year a Fire Threatens a Denver Restaurant

A fire broke out in the early morning hours on Wednesday, October 19th, at a Denver restaurant for the second time this year. According to CBSDenver.com, the Urban Sombrero on 16221 E. 40th Ave. has received several thousands of dollars in damage from a previous fire earlier in the year. This previous fire was thought to have been caused by arson. A man who had bombed a bookstore in Lakewood was the only suspect in the case. There is no indication yet as to the origin of the fire that most recently broke out, firefighters are still investigating the scene. Because the fire started during non operating hours, no one was injured as a result of the fire. If this had occurred later in the day however, this easily could have been a very dangerous situation for innocent customers.
